لقد قرأت إجابة السؤال رقم : 36567 ، وفيها في الفقرة الأخير من الإجابة : وإن احتاج إلى أخذه فله أخذه ولا شيء عليه .... ، أو يحتاج إلى قصه لمداواة جرح ونحوه ، فهل تندرج حالتي تحت مقولة " لمداواة جرح ونحوه " الذي عندي ليس بجرح ، لكنه جزء من الشارب لا ينبت به شعر ويضعني ذلك في موقف محرج إذا لاحظه أحد مع ظهور باقي شعر الشارب ، فهل يجوز لي أن احلقه تجنباً للإحراج ؟

الحمد للهأولًا :
أخذ المضحي من شعره وظفره وبشرته ، مسألة خلافية بين أهل العلم ، والمرجح في الموقع : أنه لا يجوز الأخذ من الشعر والظفر والبشرة لمن أراد أن يضحي ؛ لقوله عليه الصلاة والسلام " إِذَا رَأَيْتُمْ هِلَالَ ذِي الْحِجَّةِ ، وَأَرَادَ أَحَدُكُمْ أَنْ يُضَحِّيَ ، فَلْيُمْسِكْ عَنْ شَعْرِهِ وَأَظْفَارِهِ " رواه مسلم :1977 ، وفي لفظ آخر لمسلم " إِذَا دَخَلَتْ الْعَشْرُ ، وَأَرَادَ أَحَدُكُمْ أَنْ يُضَحِّيَ ، فَلَا يَمَسَّ مِنْ شَعَرِهِ وَبَشَرِهِ شَيْئًا " .

ثانيًا :
إذا كان ترك الأخذ من شعر الشارب يسبب شينا ظاهرا ، أو أذى وحرجا – كما ذكرت - ؛ لوجود موضع لا ينبت فيه الشعر ، فالذي يظهر – والله أعلم – أنه يجوز لك في هذه الحال الأخذ من شعر الشارب ؛ دفعًا للحرج .
قال الشيخ ابن عثيمين رحمه الله " من احتاج إلى أخذ الشعر والظفر والبشرة ، فأخذها فلا حرج عليه مثل : أن يكون به جرح ، فيحتاج إلى قص الشعر عنه ، أو ينكسر ظفره ، فيؤذيه فيقص ما يتأذى به ، أو تتدلى قشرة من جلده ، فتؤذيه فيقصها ، فلا حرج عليه في ذلك كله " انتهى من " مجموع فتاوى ابن عثيمين " 25/161 .

I
read the answer to question no. 36567, in which it says in the last
paragraph of the answer: “If he needs to remove it then he may do so,
and there is no blame on him, such as if … he needs to cut his hair in
order to treat a wound and the like.” Does my case come under the
heading of “to treat a wound and the like”? Because what I have is not a
wound; rather it is a part of the moustache where no hair grows, and
it puts me in an embarrassing situation if anyone notices it when the
rest of the hair of the moustache appears. Is it permissible for me to
shave it so as to avoid embarrassment?

Firstly:
With regard to the person who is going to offer an udhiyah removing anything from his hair, nails or skin, this is an issue concerning which the scholars differed. The more correct view, as stated on this website, is that it is not permissible to remove anything from the hair, nails or skin for the one who wants to offer an udhiyah, because the Prophet (blessings and peace of Allah be upon him) said: “When you see the new moon of Dhu’l-Hijjah, and one of you wants to offer a sacrifice, let him leave his hair and nails alone.” Narrated by Muslim (1977). According to another version also narrated by Muslim: “When the ten (days of Dhu’l-Hijjah) begin, and one of you wants to offer a sacrifice, let nothing touch his hair or skin.”

Secondly:
If refraining from removing hair from the moustache will look odd or cause embarrassment – as you mentioned – because of there being a spot where no hair grows, then what appears to be the case – and Allah knows best – is that it is permissible for you in this case to remove hair from the moustache, so as to avoid embarrassment.
Shaykh Ibn ‘Uthaymeen (may Allah have mercy on him) said: If a person needs to remove anything from his hair, nails or skin, then there is no blame on him for removing it, such as if he has a wound and he needs to trim the hair from around it, or if he breaks an nail and it bothers him, so he trims whatever is bothering him, or if he has a piece of dead skin and it is bothering him, so he cuts it off. There is no blame on him in any of these cases.

J'ai lu la réponse donnée à la question n° 36567 à la fin de laquelle figure cette paragraphe:« Si on se les coupe parce qu'on a besoin de le faire, on n'encourt rien... il en serait de même si on en avait besoin pour soigner une blessure ou pour un autre cas pareil» Mon cas entre -t-il dans le champs d'application de « pour soigner une blessure ou pour un autre cas pareil» Je n'ai pas de blessure mais une partie de ma moustache est dégarnie et le fait que les gens s'en aperçoivent me gêne. M'est-il permis de la raser pour éviter cela?
Louanges à Allah Premièrement, le fait pour le futur sacrificateur de se couper des cheveux, de se tailler ses ongles ou de prélever un morceaux de sa peau fait l'objet d'une divergence au sein des ulémas. L'avis jugé le mieux argumenté dans ce site est que les dits actes ne lui sont pas permis, compte tenu de la parole du Prophète (Bénédiction et salut soient sur lui):«Quand vous apercevez le croissant lunaire annonçant l'entrée de Dhoul-Hidjdjah et si l'un d'entre vous veut procéder à un sacrifice, qu'il s'abstienne de se couper les cheveux et de se tailler les ongles.» (Rapporté par Mouslim,1977) Une autre version précise: «Qu'il ne touche pas à ses cheveux et poils.» Pour davantage d'informations, voir la réponse donnée à la question n° 83381 et la réponse donnée à la question n° 36567. Deuxièmement, si l'enlèvement d'une partie de la moustache donne une apparence désagréable ou fait mal ou provoque une blessure (?) comme vous l'avez mentionné puisqu'il y a un endroit sans cheveux, il me semble- Allah le sait mieux- que dans ce cas il vous est permis de diminuer la moustache, pour éviter la gêne. Cheikh Ibn Outhaymine (Puisse Allah lui accorder Sa miséricorde) dit: «Si on a besoin de se couper des cheveux, de se tailler des ongles ou de prélever un morceau de sa peau, il n' y a aucun inconvénient à le faire. C'est le cas de celui qui souffre d'une blessure et doit en éloigner les cheveux et celui qui a une ongle cassée de sorte à lui faire mal et entraîner le besoin de se débarrasser de la partie atteinte et celui dont un morceau de la peau se détache et lui fait mal et l'oblige à le couper.
